This Term of Use - referred to as "Terms" - applies to your use of the SPOD VPN & Web Filter app, software and associated services - referred to as "Services". Your use of the Services indicates that you agree with the Terms, please read carefully.
Software licenses and updates
Access to our Services requires you to download and install our App - referred to as "Software" on your device (Android, macOS, iPhone or iPad). This includes a non-exclusive, non-transferable and revocable license to use the Software solely for your personal purposes for a limited period of time. This license is effective through your installation or use of the Software in accordance with the Terms. All rights and licenses not expressly granted to you under this agreement are retained by SPOD. We may update the software on your device automatically to provide new features and security updates.
Intellectual property
The Software and other technologies we use to provide the Services are protected by copyrights, trademarks, and other laws in Brazil and in other countries. These terms do not give you the right to use the trademarks, logos, domain names or other features of the trademark
Content responsibility
All content submitted or available through the Services is the sole responsibility of the person or entity who uploaded or accessed the content. SPOD shall not be responsible for the content and other information disclosed or delivered through or in connection with the Services. You agree to assume all risks associated with the use of such information
Help and technical support
We do our best to provide a great service, but we have no obligation to provide support or maintenance for the Services under this agreement. However, we may, in our sole discretion, provide limited technical support and updates to the Services.
Termination and refunds
You may terminate this Agreement at any time by discontinuing or stop accessing the Services. We may terminate this agreement and its use at any time, without cause and without notice. In the event of termination, you agree to uninstall and stop using the Services. Terminations and refunds are subject to iTunes/App Store and Google Play policies.
Restrictions
You agree that you will not attempt or, in fact, engage in the following activities regarding the Service: examine, verify, or test the vulnerability of any system or network; violate or circumvent any security or authentication measures; access, tamper with or use non-public areas of the Services, areas of Services to which you have not been invited, including SPOD's computer and server networks or our service providers; or commercialize, reproduce, modify, translate, create any derivative works, circumvent, disable, decompile, disassemble, reverse engineer or attempt to obtain the source code of the Services.
Severability
If any of the Terms, or portions thereof, are invalid or unenforceable, the court shall amend the Terms to include an executable term as close as possible to the intent of the original term. All other terms will remain unchanged.
Waiver
SPOD's relinquishment or failure to exercise any right set forth in the Terms shall not be deemed a waiver of any current or future right in the Terms.
Warranties
To the maximum extent permitted by law, SPOD makes no warranty or representation with respect to the Services, its quality, performance, merchantability
or fitness for a particular purpose. As a result, the Services are provided "as is" and you assume all risks related to their quality and performance.
You understand and acknowledge that SPOD shall not be liable for any problems attributable to the operation of the Services.
Limitation of liability
You expressly agree that SPOD shall in no case be liable for any direct, indirect, special, incidental, consequential or exemplary damages, including, without limitation, damages for loss of profits and loss of profits arising out of the use or inability to use of the Services, even if advised of the possibility of such damages. Your sole right or remedy in relation to any problem or dissatisfaction with the Services is to uninstall and stop using the Services. In any case, direct damages are limited to the amount paid by the last renewed subscription plan (1 month or 1 year).
Cancellation of Services
SPOD reserves the right to terminate the provision of Services at any time to any user who violates the Terms or any applicable law.
Current legislation and dispute resolution
The Terms and any litigation arising out of your use of the Services shall be governed by and construed in accordance with the Brazilian Law. All disputes related to the Terms will be resolved at the City of Barueri - SP Forum. You and SPOD agree to submit to the jurisdiction and agree that the venue is appropriate in any legal action or proceeding.
Changes to the Terms
We may make changes to the Terms, with or without notice, so we recommend that you review the policy periodically. This Terms is available on our website.
